Josephine Elizabeth Kenney

Josephine Elizabeth Kenney is the Senior Vice President of Compliance and Senior Compliance Counsel for First Advantage and is responsible for regulatory compliance and support across its product lines. Prior to joining First Advantage in June of 2004, Josephine was Director of Special Services and Compliance at ChoicePoint. She has significant experience in the occupational health market, founding Professional Testing Services in 1989, which later was acquired and merged into ChoicePoint.

Josephine produces a large number of workplace testing related policy and compliance support materials for First Advantage, contributes to the First Advantage Quarterly E-Newsletter, conducts Quarterly Client Webinars, is widely published on the subjects of drug testing and drug testing law and is a frequent speaker at conferences sponsored by organizations such as the Substance Abuse Administrator’s Association (SAPAA) and the American Association of Medical Review Officers (AAMRO). Josephine was a contributing author to the Medical Review Officer’s Handbook, 9thEdition, by Theodore F. Shults, JD, MS, contributing the text for Chapter 9, State Law, Navigating the Matrix.She was also the primary author for a Medical Review Officer Continuing Education Monograph for MROCC, a Medical Review Officer Certification body. Josephine is a recognized expert in federal and state drug testing law including matters of privacy and compliance. Josephine is on SAPAA’s Board of Directors, chairs its International Committee, and Co-Chairs its Governmental Affairs Committee. Josephine is also a recent Past President of SAPAA.

Josephine has significant experience in Employment Workplace Drug and Alcohol Testing, Fleet Safety Matters, Background Screening, Biometrics, and Immigration Compliance – I-9 and E-Verify.

Relative to speaking engagements, from 2008 through 2011, Josephine was a featured speaker at International Forums for Drug-Free Workplaces (IFDAT) in Sao Paulo, Brazil, Barcelona, Spain, and Houston, Texas, providing an overview of the emerging international workplace drug testing market. Josephine also made many presentations over the years at SAPAA’s Annual Meeting and DATIA’s Annual Meetings presenting on such topics as Medical Marijuana and Legalities of Alternative Specimens. Josephine has been a Trainer for the SAPAA Training Institute’s Workshop on International Drug Testing: World Overview and lead two workshops on state law workplace drug testing issues and is a regular trainer at the American Medical Review Officer Association (AAMRO). She is also a qualified Urine Specimen Collector and Instructor, a Certified Breath Alcohol Technician and a Factory Authorized Operator and Calibration Technician on the Phoenix 6.0 Evidential Breath Tester.

Josephine also has significant historical practical experience relative to Federal Railroad Administration (FRA) and United States Department of Transportation service support delivery. As Key Personnel for a Government Contract with the Federal Railroad Administration from late 2004 through July 2007, Josephine provided direct Contractor Consulting and program support, leading the First Advantage Team in support of an FRA Technical Oversight Contract. Her support included FRA Post-Accident Laboratory Toxicology Inspections participation and direction, Laboratory Quality Assurance Program oversight, participation in Railroad Compliance Reviews, Inspector Training Sessions, and FRA Roundtable Meetings and Consultation services. Josephine continues as Key Personnel on a Contract which provides forensic drug testing laboratory inspection support to the United States Department of Defense.

A graduate of Smith College and the University of Connecticut, School of Law and licensed to practice law in the State of Connecticut, Josephine is a member of the First Advantage Legal Team. Josephine also holds a Masters in Business Administration – Human Resources Graduate Degree from Thomas College. She combines nearly three decades of business experience, jurisprudence, entrepreneurship, and industry insight in her daily Industry work.
